38.01 List of Days Bargaining unit members will have the following holidays: 1. New Year's Day - (first day in January) 2. Martin Luther King's Birthday - (third Monday in January) 3. President's Day - (third Monday in February) 4. Memorial Day - (last Monday in May) 5. Independence Day - (fourth of July) 6. Labor Day - (first Monday in September) 7. Columbus Day - (second Monday in October) 8. Veteran's Day - (eleventh of November) 9. Thanksgiving Day - (fourth Thursday in November) 10. Christmas Day - (twenty-fifth of December) 11. Any day declared as a holiday by the Governor of the State of Ohio or the President of the United States. For employees who are working other than Monday through Friday schedules, holidays will be observed on the days listed in this section. 38.02 Holiday Pay Full-time bargaining unit members are automatically entitled to eight (8) hours of holiday pay at regular rate or the number of hours that they are normally scheduled to work over eight (8) hours (e.g. employees scheduled to work ten (10) hours per day should receive ten (10) hours of holiday pay), regardless of whether they work on the holiday. Compensation for working on a holiday is in addition to the automatic hours of holiday pay and shall be computed at the rates prescribed in Section 38.03 of this Article. Employees who work other than a full time schedule shall receive four (4) hours of holiday pay at their regular rate regardless of whether they work on the holiday. 1. If the holiday occurs during a period of pre-approved sick, personal or vacation leave the employee shall not be charged for sick leave, personal or vacation for the holiday. 2. Employees who are scheduled to work and call off sick the day before, the day of, or the day after a holiday shall forfeit their right to holiday pay for that day, unless there is documented, extenuating circumstances which prohibit the employee from reporting for duty. 3. An employee on unpaid leave of absence is on nopay status and shall not receive payment for a holiday. A leave of absence shall neither start nor end on a holiday. 4. An employee in no-pay status shall not receive holiday compensation. 5. A holiday falling on a Saturday will be observed on the preceding Friday, and a holiday falling on a Sunday will be observed on the following Monday. Bargaining unit members with work schedules other than Monday through Friday are entitled to pay for any holiday observed on their day off. 38.03 Computation of Holiday Pay Employees shall have their choice of pay or compensatory time for work performed on a holiday resulting in premium pay. A. Scheduled Holiday Hours An employee who is required to work on a Holiday, as part of the regular 40-hour weekly schedule, will receive “Premium Pay” for this holiday work. “Premium Pay” includes pay for the Holiday, itself, at regular rate straight time pay, plus pay at the rate of one and one-half (1 ˝ ) times the regular rate of pay for all hours worked on the Holiday. B. Unscheduled Holiday Hours Employees called in for, or offered overtime for, a Holiday not previously scheduled, will be compensated at the following rates: Regular rate straight time pay for the Holiday, plus pay at the rate of two and one-half (2 ˝) times the regular rate of pay for all hours worked on the Holiday. |
