ARTICLE 5 - CONFLICT AND AMENDMENT
This Agreement is meant to conform to and should be interpreted in conformance
with the Constitution of the United States, and the Constitution of the State of
Ohio, all applicable federal laws, and Chapter 4117 of the Ohio Revised Code.
Amendments and modifications of this Agreement may be made by mutual written agreement of the parties to this Agreement, subject to ratification by the Labor Council and the General Assembly. All Memoranda of Understanding, amendments, Letters of Intent, or any other mutually agreed to provisions, shall be reviewed by the FOP, the Office of Collective Bargaining (OCB), and agency representatives for determination of their force and effect. Unless otherwise mutually agreed by the parties, those Memoranda of Understanding, amendments, Letters of Intent, or any other mutually agreed to provisions entered into prior to July 1, 2009, shall expire and have no further force and effect upon the expiration of the 2009-2012 Agreement, except those which have or do confer an economic benefit. The Office of Collective Bargaining will be responsible for assembling all such mutual agreements. Should any provision of this Agreement be in conflict with any State law, administrative rule or directive in effect at time of the signing of this Agreement, the provisions of this Agreement will prevail except for Chapter 4117 of the Ohio Revised Code and those sections expressly prohibited in Chapter 4117. |
